This Privacy Policy (“Privacy Policy”) applies to all users of boardroom.tv and its associated websites, subdomains, mobile versions, any associated applications and services (collectively, the “Website”) which are operated by Boardroom 35 LLC (“Boardroom,” “we,” “us,” and “our,”) where this Privacy Policy is posted.
Boardroom understands that your privacy is important to you and that you care about how your Personal Information is used and shared online. We respect and value the privacy of everyone who visits the Website, and will only collect and use Personal Information in ways that are described here, and in a manner that is consistent with our obligations and your rights under the law. In conjunction with the Terms of Service which may be accessed here, this Privacy Policy sets out the basis on which any Personal Information you provide will be collected, processed, used, shared, and stored by us. Please read it carefully. By visiting the Website, you are accepting and consenting to the practices described in this Privacy Policy, which may be amended at our sole discretion from time to time. If you use the Website after we have published such changes, you will be agreeing to be bound by those changes. If you do not agree to be bound by this Privacy Policy at any time, you should not use the Website.
WHAT DO WE MEAN BY “PERSONAL INFORMATION?”
“Personal Information” or “personal data” as used herein is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. Personal Information that is “publicly available,” “aggregated,” or “de-identified” as those terms are defined by applicable law, is not considered “Personal Information” for the purposes of this Privacy Policy.
REGISTRATION ON THE WEBSITE AND COLLECTION OF PERSONAL INFORMATION FROM CHILDREN
You must be the age of Majority or older (18 in most states of the United States; older in some jurisdictions) to create an account on the Website, if account creation becomes available. While individuals under the age of 18 (but not younger than 13) may use the Website, they must do so only with the consent and involvement of a parent or legal guardian, under such person’s account and otherwise subject to our Terms of Service. The Website is not directed to children under the age of 13, and we do not knowingly collect Personal Information from children under the age of 13. If we become aware that you are under the age of Majority and are attempting to or have submitted Personal Information via the Website, we will not accept such information and we will take steps to remove such information from our records. This may involve us having to access and verify your age and other relevant details.
PERSONAL INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT
- Depending on our interactions with you, we may have collected the following personal information about you during the preceding 12 months.Identifiers and personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)): For example, when you sign up for our newsletter, we ask for information such as your email address. We also acquire your Internet protocol address and/or mobile device identification when you use the Website.
We may capture user information, including Personal Information, when users send us questions or comments via e-mail. Personal Information collected in this manner will only be used to contact the user and/or respond to the user’s inquiry/issue. Sending us an e-mail will not enroll you on our e-mail list unless you specifically request it.
- Internet or other network activity: We may collect you browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement.
- Geolocation information: We may collect information regarding your physical location.
- Commercial information: For purchases made through the Website, a third-party payment processor will collect your full name, email address, postal address, contact details and credit or debit card information (“Billing Information”). This record will be stored and processed in the United States and other countries. By making a purchase, you grant to us and to all other persons and entities involved in the operation of the Website the right to use, store, monitor, retrieve and transmit your account information in connection with the operation of the Website and as otherwise provided herein. You also agree that such access and use of your Personal Information is governed by the third party’s privacy policies. We are not responsible or liable for the content, activities or privacy policies of any third-party sites. Accordingly, please refer to their respective privacy policies.
- We may also obtain your Personal Information through your use of social media depending on your settings or the privacy policies of these websites. To change your settings on these services, please refer to their respective privacy notices.
- Sensitive Personal Information: We may collect Personal Information defined as “sensitive” under state privacy laws. This may include government identification cards as may be necessary to verify your Billing Information.

COLLECTION OF PERSONAL INFORMATION FROM JOB APPLICANTS
When you apply for a job with us, we may collect identifiers, professional or employment-related information, and education information from you via the Website forms or otherwise, including:
- Information you provide in connection with your application;
- Information about you that is publicly available;
- Health information, including disability information;
- Information that you authorize us to collect via third parties, including former employers or references;
- Any other information provided in connection with your application.
We only use your Personal Information to assess your skills in relation to the applicable job requirements. We may also use your Personal Information to contact you during the hiring process.
In certain circumstances, you may submit your application for employment through a third-party service that displays our job posting. We do not control the privacy practices of these third-party services. Please review their privacy policies carefully prior to submitting your application materials.
COOKIES AND OUR ANALYTICS TOOLS
We and third parties operating on the Website may use cookies, log files, clear gifs, pixels (including social media, advertising, and newsletter pixels) and/or similar devices to identify you, to keep track of the user’s interactions with the Website, to enhance certain activities available on the Website, and for analytics and advertising purposes. Cookies are small text or other electronic files that are used for user-identification and verification purposes, to allow us to deliver personalized advertising and content to you, for record-keeping and analytics purposes, and to increase the ease of use of the Website. We may use persistent or not-persistent cookies. Users can remove or reject persistent cookies by following the directions provided in their Internet browser’s “help” file. If a user removes a persistent cookie or rejects persistent cookies, the functionality of the Website, or any part thereof, may be impaired or unavailable.
- Google Analytics, Tableau, and Google Advertising: To help facilitate the delivery of relevant content, we use Google Analytics, Tableau, and Google Advertising. These services use cookies to report on user interactions on our and others’ websites. We use the information collected to understand and improve how the Website is used and for optimizing marketing, refining advertising, and/or programming strategies, and generally improving users’ experience on the Website. For example, blocking all cookies on the Website may result in your browser not remembering log-in information or other preferences. We do not sell your personal information for monetary compensation, but we partner with third-party advertising and analytics partners, which may be considered a “sale” or “sharing” of personal information under applicable laws. HOW WE RESPOND TO “DO NOT TRACK” SIGNALS AND THE GLOBAL PRIVACY CONTROL
Please note that your browser settings may allow you to automatically transmit a “Do Not Track” signal to websites and online services that you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, we do not alter our practices when we receive a “Do Not Track” signal from a visitor’s browser. HOW WE USE THE PERSONAL INFORMATION WE COLLECT
We may use the Personal Information we collect in the following ways:
- to provide users and members of the Members Club with news, events, personalized offers, promotions and other relevant information. Such marketing and other uses of your personal Information is in response to a request from a user to receive newsletters, marketing emails or similar communications, or when a user has expressed interest in such content or services;
- to contact users and members of the Members Club with updates and relevant information about our content, products and/or services because they have signed up to do so through the Website;
- to quickly process user requests for information and to allow us to respond efficiently to user questions;
- to monitor Website statistics;
- to respond to or satisfy legal requirements, such as a court order, a subpoena, or a law enforcement agency’s or other public agency’s request;
- to help prevent the instigation of a crime, to help facilitate an investigation related to public safety, to help protect the safety of a child using the Website, to help protect the security or integrity of the Website, or to enable us to take precautions against liability;
- to provide information to service providers or such companies who provide support for the operations of the Website and who do not use or disclose the information for any other purpose;

HOW YOUR INFORMATION MAY BE SHARED
Except as set forth below, we do not sell, trade, or otherwise transfer to third parties our users’ Personal Information unless we receive their consent. That being said, in the following situations, we may share Personal Information with outside parties:
- Affiliates and Sponsors. In connection with our content and advertisements, which you would only receive after opting-in, our Affiliates and/or Sponsors may collect Personal Information.
- Members Club. In connection with providing content and services to members of the Members Club, as described in more detail below. This might include disclosing Personal Information to third-party partners for the purpose of providing Club services and events.
- Subsidiaries, Website Consultants, Vendors, and Advertising and Analytics Companies. We may disclose Personal Information to our subsidiaries, third party consultants and vendors (such as providers of hosting, support, maintenance; third party payment processing agencies; remedial and repair services; and personalized advertising and analytics services) to the extent that they require access to our databases, or the information contained in our databases, to provide services to us;
- Enforcement of Rights/Security. We reserve the right to release Personal Information (i) when we are under legal compulsion to do so (e.g. we have received a subpoena) or we otherwise believe that the law requires us to do so, (ii) when we believe it is necessary to protect and/or enforce the rights, property interests, or our safety, the safety of our users, or the safety of others, or (iii) as we deem necessary to resolve disputes, troubleshoot problems, prevent fraud and otherwise enforce the Privacy Policy and other Website user agreements;
- Reorganization or Sale. In the event that we merge with or become a part of another organization, or in the event that we are sold, we sell all or substantially all of our assets, or we are otherwise reorganized, the information you provide will be one of the transferred assets to the acquiring or reorganized entity;
- To Help Protect Minor Users of The Website. In the event that the safety of our users is threatened, and we are able to do something about that by sharing PI with third parties, we reserve the right to do so. This may be done to prevent the instigation of a crime, to help facilitate an investigation related to public safety, to help protect the safety of a child using the Website, to help protect the security or integrity of the Website, or to enable us to take precautions against liability;
- As Otherwise Allowed by Law. We may transfer Personal Information to third parties where we are expressly authorized by applicable law to do so;
- Aggregated Information. We may aggregate information that you provide with information provided by other individuals in such a manner that the information is not personally identifiable to you, and we may transfer that aggregated information to third parties;
- We may make available services such as blogs, message boards and chat functionality to which you are able to post information and materials. Please note that any information you disclose through such services or otherwise on the Website becomes public information, and may be available to visitors to the Website and to the general public. In addition, when you choose to make a posting on such services certain Personal Information will be available for other users to view. We urge you to exercise discretion and caution when deciding to disclose Personal Information about you, or any other information, on the Website. WE ARE NOT RESPONSIBLE FOR THE USE BY ANY THIRD-PARTY OF ANY PERSONAL INFORMATION YOU VOLUNTARILY DISCLOSE THROUGH ANY SUCH SERVICES OR OTHERWISE ON THE WEBSITE; and
- With your express consent.
NOTICE REGARDING PERSONAL INFORMATION COLLECTED FOR PURPOSES OF THE MEMBERS CLUB
Boardroom operates an exclusive Members Club program. When you apply for the Members Club using the form located here: https://apply.boardroom.tv/Y1-application Boardroom may collect the following types of Personal Information from you to assess your candidacy for the Boardroom Members Club: Name, Birthday, Email, Phone number, Physical mailing address, a current photo of yourself, Your employer’s name, and any Personal Information you input into the free text fields located on the form. Please note that we use this information collected on this form for the purposes described in the application form.
Please note that if you are including the name and contact information of another individual as a referral on the Members Club application form, we expect that you have already received that individual’s consent to provide us with their Personal Information for the purpose of providing a referral. We expect that they have consented to us contacting them for these purposes.
Once you become a member of the Members Club, we may disclose the Personal Information you provide to us in order to provide you with Club services or other Club perks. This could involve disclosing your Personal Information to our business partners including: event venues where we host exclusive Members Club events, sports and fitness partners that host group fitness classes for members, and companies that host other types of events for members, such as wine tastings and networking events.

HOW WE STORE AND TRANSFER INFORMATION ABOUT YOU
The Website is hosted in the United States. In order to communicate with you about content, the information that we collect from you may be transferred to, stored, used and processed by Boardroom in the United States or one of our service providers based in the United States or outside of the United States. Such entities may be engaged in, among other things: (i) preparing and sending newsletters to which you subscribe; (ii) the processing of payment details; and (iii) the provision of support services.
If you are visiting from the European Union or other regions with laws governing information collection and use that may differ from United States law, please note that you are transferring your Personal Information to the United States. The laws of some countries may not provide the same levels of protection of Personal Information as your home country, particularly if you are resident in the European Union. By submitting information, you agree to the collection, transfer, storage, use and processing of information about you for the purposes described in this Privacy Policy. When you provide Personal Information to us or our service providers or vendors, you consent to the processing of your information in the United States as the Website is operated in the United States. YOU ACKNOWLEDGE THAT THE LAWS OF THE UNITED STATES TREAT YOUR INFORMATION IN A MANNER THAT MAY BE SUBSTANTIALLY DIFFERENT FROM, AND LESS PROTECTIVE THAN, THE TREATMENT REQUIRED UNDER THE LAWS OF OTHER COUNTRIES AND JURISDICTIONS. IF YOU DO NOT WANT YOUR INFORMATION TRANSFERRED TO THE UNITED STATES, YOU SHOULD NOT SHARE YOUR PERSONAL INFORMATION WITH US, OR MAKE USE OF THE WEBSITE.
TO THE EXTENT ALLOWED BY THE LAW OF THE COUNTRY IN WHICH YOU ARE LOCATED, YOU EXPRESSLY WAIVE ANY RIGHT YOU MAY HAVE TO REQUIRE US TO TREAT YOUR IDENTIFYING INFORMATION IN ACCORDANCE WITH THE LAWS OF ANY COUNTRY OR JURISIDICTION OTHER THAN THE UNITED STATES. HOWEVER, THE FOREGOING WAIVER MAY NOT BE LEGALLY BINDING IN SOME COUNTRIES, SUCH AS THE MEMBER STATES OF THE EUROPEAN UNION. TO THE EXTENT IT IS NOT LEGALLY BINDING IN THE COUNTRY IN WHICH YOU ARE LOCATED, THIS FOREGOING WAIVER DOES NOT APPLY TO YOU.
DATA SECURITY
The security of your Personal Information is important to us. We implement reasonable technical and organizational security measures to protect the Personal Information submitted to us, both during transmission and once it is received. Boardroom takes steps to ensure that such data remains private and confidential. We restrict access to Personal Information to Boardroom employees, contractors, and agents who need to know that information in order to operate, develop, or improve the Website. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
The Internet is a global network and, therefore, there are times when information about you travels globally and may not always be completely secure. If you provide us with information over the Internet, this will be at your own risk. By using the Website, you agree and authorize us to process information in this way. However, please be assured that we use commercially reasonable procedures and security features to prevent unauthorized access to information about you.
RETENTION OF PERSONAL INFORMATION
We may retain your Personal Information for as long as needed to provide you with the Website, comply with our legal obligations, resolve disputes, and enforce our agreements. Even if you delete your account, keep in mind that deleted information may persist in backup copies for a reasonable period of time.
PUBLIC POSTING AREAS
Please note that any Personal Information you post to any public posting area, such as the comment section of our social media sites, is available to anyone with Internet access worldwide. If you don’t want people to know your email address, for example, don’t include it in any message you post publicly. PLEASE BE EXTREMELY CAREFUL WHEN DISCLOSING ANY INFORMATION IN PUBLIC POSTING AREAS. WE ARE NOT RESPONSIBLE FOR THE USE OR DISCLOSURE BY OTHERS OF THE INFORMATION THAT YOU DISCLOSE IN PUBLIC POSTING AREAS.
HOW YOU CAN OPT-OUT FROM RECEIVING COMMUNICATIONS FROM US
You may unsubscribe from promotional emails and other commercial communications by following the instructions contained within the communication or emailing us at newsletterreply@boardroom.tv. Please note that due to marketing production schedules you may receive messages already in production.

We will endeavor to comply with your request as soon as reasonably practicable. Please keep in mind that if you opt-out of receiving promotional messages from the Website, we will continue to send you transactional messages and important account-related information regarding the Website or content or services offered through the Website.
Text or SMS Messaging: We may also offer text/SMS messaging to communicate with our Members Club regarding Members Club activities and events. In some circumstances, we might require you to opt-in to receive text messages from us. At any time, you may opt-out of receiving text messages from us by texting STOP in response to any text message. You may also opt out by logging in to your Member portal and navigating to advanced settings in your profile: https://login.boardroom.tv/account/profile/advanced.
DISCLAIMER REGARDING VIDEO CONTENT
The Website may contain video content, audiovisual content, or content of a like nature (collectively, “Video Content”). In connection with our provision of Video Content, the Website may utilize online tracking technologies and code-based tools, including, but not limited to, Software Development Kits (“SDKs”), pixels, and cookies (i.e., advertising or analytics cookies) that track information about your activity and webpage-viewing history on the Website (collectively, “Tracking Tools”). Tracking Tools on the Website may result in information about your activity on the Website being transmitted from your browser to us and third parties, which, in turn, may result in the display of targeted advertisements on third-party websites, platforms and services, including advertisements for Boardroom content. In addition, whether Tracking Tools on the Website result in your browser’s transmission of information to third parties depends on a number of factors that may be outside of Boardroom’s knowledge or control, including what third-party websites you use, what information you have provided to such third parties, and whether (and the extent to which) you have limited the use of cookies by the operators of those third-party websites, platforms, and services.
DISCLAIMER REGARDING CHAT FEATURE
The Website may also have a third-party chat feature for support purposes. At this time, our chat feature does not use artificial intelligence, it connects users to a live person. These features may collect the content of your communications and other Personal Information you provide while using the chat feature. Please discontinue use of the Website if you do not consent to the collection of such information by us and third parties.
YOUR STATE PRIVACY RIGHTS
Depending on applicable state law, you may have the right to object to our collection and use of your Personal Information at any time, or to require us to review, transmit, change, or delete your information that we have collected and retained about you. We will fulfill your request to exercise any of these rights within the applicable time period prescribed by such laws. Residents of California may have the following rights:

You may also request a copy of the Personal Information we have collected, and upon request, we will provide this information to you in readily-usable electronic form.
- You have the right to request the deletion of your Personal Information, subject to certain legal exceptions.
- You have the right to opt out of the sale or sharing of your Personal Information to third parties.
- You have the right to correct your Personal Information if inaccurate.
- You have the right to limit the use and disclosure of your sensitive Personal Information if we use such information to infer characteristics about you. Note that for precise geolocation information collected through a mobile device, you will need to update your settings. To do this on an iPhone, (1) go to Settings > Privacy > Location Services > and choose an app; (2) Select the app > tap on “location;” (3) Scroll down and slide the “Precise Location” toggle to Off. To do this on an Android, (1) go to Location Services > Google Location Accuracy; and (2) Toggle Improve Location Accuracy to Off.
- You have the right to not be discriminated against for exercising any of these rights, including where financial incentives are offered.
- You have the right to opt out of profiling using automated decision-making technology. You may have the right not to be subject to a decision based solely on profiling, except under certain exceptions under local law.
Separate from the CCPA, California’s Shine the Light law gives California residents the right to ask companies what Personal Information they share with third parties for those third parties’ direct marketing purposes. We do not disclose your Personal Information to third parties for the purpose of directly marketing their goods or services to you unless you request such disclosure. Residents of other US states may have the following rights:
- The right to opt out of “sales” of Personal Information and use of your Personal Information for “targeted advertising,” as those terms are defined under applicable law.
- The right to opt out of “profiling” under certain circumstances, as defined under applicable law.
- The right to access and the right to confirm processing of your Personal Information under certain circumstances.
- The right to obtain a copy of, or representative summary of, your Personal Information in a portable and, to the extent technically feasible, readily usable format.
- The right to obtain a list of the categories of third parties to which we have disclosed your Personal Information or (the right to request a list of the specific third parties to which we have disclosed your Personal Information.
- The right to question the result of profiling, where your Personal Information is profiled in furtherance of decisions that produce legal or similarly significant effects concerning you. This includes the right to be informed of the reason the profiling resulted in the decision, be informed of what actions you might have taken and can take to secure a different decision in the future. Residents of some states may allow an authorized agent, such as another individual or business, to submit a request on your behalf. We may verify such a request as authorized by law.
We will not discriminate against you for exercising your rights under applicable law. We may have a reason under the law why we do not have to comply with your request, or why we may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response.
Verification. We must verify your identity, or whether your authorized agent is in fact authorized by you to make a request, before responding to your request or that of your authorized agent. We may verify your identity by asking you to provide personal identifiers that we can match against information we may have collected from you previously. We may need to follow up with you to request more information to verify identity. We will not use Personal Information we collect in connection with verifying or responding to your request for any purpose other than responding to your request. For authorized agents, we may require documentation demonstrating your agent’s authority to submit requests on your behalf, such as a valid power of attorney or other documentation, including a letter, signed by your authorizing the agent to submit your requests.
Appeals. You may also have a right to appeal a denial of your request by contacting us as described in the notice of denial.
Nevada Disclosure: Residents of Nevada have the right to opt-out of the sale of certain pieces of their information sold to third parties. Currently, we do not engage in such sales. PRIVACY POLICY CHANGES
We may need to update this policy from time to time, and we reserve the right to do so as we deem necessary. If we change this Privacy Policy, we will notify you of such changes by revising the “Last Revised Date” provided herein, and/or by any other legal means, and your use of the Website after any such changes shall constitute your consent to such changes. We encourage you to periodically review this page for the latest information on our privacy practices.
